By accessing and using our website located at www.kairogear.com (the "Site") and purchasing our products, including Audio Players, Keyboards & Accessories, Watches, and Recording Devices, you agree to be bound by the following Terms of Service. Please read them carefully before placing an order.

These terms constitute a legally binding agreement between you ("User," "Customer," or "you") and KairoGear ("we," "us," or "our"). If you do not agree with any part of these terms, you must not use our Site or services.

To the fullest extent permitted by applicable law, KairoGear, its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Any conduct or content of any third party on the Site.
  • Any content obtained from the Site.
  • Unauthorized access, use, or alteration of your transmissions or content.

Our total liability for any claim arising out of or relating to these Terms or the products sold shall not exceed the amount you paid for the product(s) giving rise to the claim. This limitation applies regardless of the legal theory on which the claim is based.

Intellectual Property Protection

The KairoGear Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, and the design, selection, and arrangement thereof) are owned by KairoGear, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, except as incidental to your normal use of the Site for personal, non-commercial purposes. The "KairoGear" name and logo, and all related names, logos, product and service names, designs, and slogans are trademarks of KairoGear or its affiliates or licensors. You must not use such marks without our prior written permission.

Refund & Return Policy

We strive for complete customer satisfaction. If you are not satisfied with your purchase, you may return eligible items within 30 days of the original purchase date for a refund or exchange, subject to the conditions below.

Eligibility: The item must be unused, in its original packaging, and in the same condition as when you received it. It must also include the original receipt or proof of purchase. Certain products, such as software or opened recording media, may not be eligible for return due to copyright protection.

Process: To initiate a return, please contact our customer support team at [email protected] to obtain a Return Merchandise Authorization (RMA) number and instructions. Returns sent without an RMA number will not be accepted.

Refunds: Once your return is received and inspected, we will notify you of the approval or rejection of your refund. If approved, your refund will be processed, and a credit will automatically be applied to your original method of payment within a certain number of business days. Shipping costs are non-refundable unless the return is due to our error (e.g., wrong item shipped).

Damaged or Defective Items: Please contact us immediately at [email protected] if you receive a damaged or defective product. We will arrange for a replacement or refund and cover the return shipping costs.

Governing Law

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
